Terms of Service

These Terms of Service ("Terms") govern your use of the Chocolingo mobile application and website ("App"), operated by Chocolingo ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

2. Account Registration

To access most features of the App, you must create an account using Apple or Google Sign-In. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

3.1 Permitted Use

Chocolingo is an English language learning application for personal, non-commercial use. You may use the App to learn English, complete quizzes, review flashcards, and track your progress.

3.2 Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or extract source code from the App
  • Abuse, exploit, or manipulate the XP system or any game mechanics
  • Create multiple accounts to gain unfair advantages
  • Use automated tools, bots, or scripts to interact with the App
  • Upload or transmit any malicious code or harmful content
  • Harass, impersonate, or harm other users

4. XP System and Virtual Currency

Chocolingo uses an XP (experience points) system as a form of virtual currency. XP is earned by completing quizzes and activities within the App.

Important: XP has no monetary value, cannot be transferred between accounts, cannot be exchanged for real money, and will be forfeited if your account is terminated. We reserve the right to modify XP earn rates, costs, and the availability of items at any time.

5. App Updates

We may require you to update to the latest version of the App to continue using it. When a mandatory update is required, the App will display a blocking notification until you update. We recommend enabling automatic updates on your device.

6. Intellectual Property

All content within the App, including but not limited to text, graphics, quiz questions, flashcard content, audio, design, and software, is the property of Chocolingo or its content licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from any App content without our express written permission.

7. User-Generated Content

The App does not currently support public user-generated content. Display names chosen by users are subject to our content standards — names that are offensive, misleading, or violate these Terms may be removed without notice.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not guarantee that use of the App will result in any particular level of English language proficiency. Learning outcomes depend on individual effort and engagement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHOCOLINGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Any XP or progress associated with your account will be forfeited.

You may delete your account at any time through the App settings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mongolia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Mongolia.
